1. The service – the surveyor provides the standard RICS Home Survey – Level 3 ('the service') described in the 'Description of the RICS Home Survey – Level 3', unless you and the surveyor agree in writing before the inspection that the surveyor will provide extra services. Any extra service will require separate terms of engagement to be entered into with the surveyor.
Examples of extra services include:
• costing of repairs; • schedules of works; • supervision of works; • re-inspection;
• detailed specific issue reports: • reinstatement cost.
The surveyor providing the RICS Home Survey – Level 3 service aims to give you professional advice to:

Help you make a reasoned and informed decision when purchasing the property, or when planning for repairs, maintenance, or upgrading the property

provide detailed advice on the condition
-
describe the identifiable risk of potential or hidden defects
-
propose the most probable cause(s) of the defects based on the inspection, and
-
where practicable and agreed, provide an estimate of costs and likely timescale for identified repairs and necessary work.
2. Before the inspection – Before the inspection, you should tell us if there is already an agreed or proposed price for the property and if you have any particular concerns about the property (such as a crack noted above the bathroom window or any plans for extension). This period forms an important part of the relationship between you and the surveyor. The surveyor will use reasonable endeavours to contact you to discuss your particular concerns regarding the property and explain (where necessary) the extent and/or limitations of the inspection and report. The surveyor also carries out a desktop study to understand the property better.
3 The surveyor – the service is to be provided by an AssocRICS, MRICS, or FRICS member of the Royal Institution of Chartered Surveyors, who has the skills, knowledge, and experience to survey, and report on the property
4 Terms of payment – you agree to pay the surveyor's fee and any other charges agreed in writing.
Our fees will be payable in full before we undertake and submit our Report.
5 Retention of Title - All goods, documents and correspondence shall remain the property of J Browne
Surveys until the invoice has been paid in full and the client shall remain a bailee until payment is made
in full. All Reports prepared and issued by J Browne Surveys is copyrighted and protected by copyright
law.
6 Cancelling this contract – you are entitled to cancel this contract by giving notice to the surveyor's office at any time before the day of the inspection. Our cancellation policy is relevant within as well as outside the 14-day cooling off period and is;
If you cancel up to 48 – 24 working hours prior to the appointment there is a £29 admin fee
If you cancel within 24 working hours prior to the appointment there is a £99 admin fee
If you cancel on the day, full charges apply.
All cancellations must be made in writing and sent to jbrownesurveys@gmail.com and all refunds will be processed within 5 working days.

If the survey is canceled due to a denial of access to the Property on the day of the Survey or lack of cooperation by an estate agent or vendor which prevents the Survey from going ahead when the Surveyor arrives at the Property then a £50.00 discretionary charge may apply to compensate the Surveyor for their time and travel expenses and we will reschedule the Survey.
7 Notice of Right to Cancel
On 1 October 2008, the ‘Cancellation of Contracts Made in a Consumer’s Home or Place of Work etc Regulations 2008’ (the Regulations) came into force. These new regulations extend the existing law on cooling-off periods and cancellation rights for consumers and cover contracts made during both solicited visits made by traders – (i.e. visits made at the consumer's request) - and unsolicited visits by traders
You have the right to cancel our contract within 7 days of receiving this Notice. If you wish to
cancel, notify us by email at jbrownesurveys@gmail.com.
You may be required to pay for services if the performance of the contract has begun with your written agreement before the end of the cancellation period.
Request to start work before cooling-off period expires:
J Browne Surveys would not normally undertake a survey until after the 7-day cooling-off period has expired. If you agree to us undertaking the survey earlier, we may agree to do so but you will still have the right to cancel the contract before the 7-day cooling-off period expires. If you cancel, we will charge you for any work we do before receiving your written cancellation notice and you will be liable to pay for any time expended on the survey to that date. If this form is signed by one of the parties then the signatory confirms that they have the authority to act solely
and on behalf of all.
